These Terms of Service govern use of https://noonawayart.com and purchases from Noonaway Art, operated by NoonawayArt Inc. By using the site or placing an order, you agree to these Terms and the policies referenced here. Nothing in these Terms limits consumer rights that cannot lawfully be excluded.

1. Eligibility, accounts, and acceptable use

You must be legally able to enter a binding contract in your jurisdiction. Information provided for an account or order must be accurate and current. You are responsible for account security. You may use the site only for lawful purposes and may not interfere with its security, operation, or other users.

2. Hand-painted, made-to-order products

All Noonaway artworks are made to order. Product images show the intended composition and color direction, but each artwork is painted individually. Small differences in brushwork, texture, color mixing, edges, and fine details are natural characteristics of hand-painted work, not defects, when the artwork still corresponds materially to the confirmed design and order specifications. Screen settings, photography, and lighting can also affect color appearance.

Available sizes, presentation options, prices, and descriptions may change before an order is placed. Any material change to an accepted order will be communicated with an option to proceed or cancel.

3. Orders, prices, and payment

Placing an order is an offer to purchase. An order is accepted when we send confirmation after payment authorization and review. We may decline or cancel for legitimate reasons such as payment failure, suspected fraud, an obvious pricing error, delivery restrictions, or inability to fulfill it. If we cancel an accepted order, we will refund the affected amount.

The price charged is the price shown at checkout, less any valid discount, plus disclosed taxes, shipping, duties, or other charges. Promotions may have separate terms. You must be authorized to use the payment method and provide accurate billing and delivery information.

4. Artwork confirmation and adjustments

We generally provide a visual confirmation within 7 to 14 days after order placement. You may approve the artwork or request reasonable adjustments before dispatch. Adjustments and drying time can extend the schedule. Approval does not remove your 30-day return right or rights concerning damaged, incorrect, or materially non-conforming goods.

5. Cancellations, returns, and refunds

You may cancel for a full refund any time before dispatch. After delivery, regularly priced and discounted artworks may be returned for any reason within 30 calendar days under our Return & Refund Policy. Contact us before returning an artwork; the business address below is not a return receiving address. After approval, we provide the correct return address and shipping instructions.

6. Shipping and delivery

Preparation and visual confirmation generally take 7 to 14 days, followed by final inspection, drying, packing, and dispatch. Carrier delivery generally takes an additional 7 to 14 days. Estimates are not guaranteed and may be affected by adjustments, customer response time, destination, customs, weather, holidays, or carrier disruption. See our Shipping Policy for details.

7. Intellectual property and third-party services

Site text, branding, images, graphics, video, and design are owned by Noonaway, its affiliates, or licensors and are protected by applicable intellectual-property laws. You may use the site for personal, non-commercial purposes only and may not reproduce or exploit its content without permission.

The store is powered by Shopify and may use other third-party services or links. Purchases are made directly with Noonaway, not Shopify. Third-party services are governed by their own terms and privacy practices.

8. Privacy, errors, and service availability

Personal information is handled under our Privacy Policy. We may correct typographical, pricing, availability, or descriptive errors. Site access may occasionally be interrupted for maintenance, security, or events outside our reasonable control.

9. Warranties and liability

Except for express promises in these Terms and rights that cannot lawfully be excluded, the site is provided on an as-available basis. To the fullest extent permitted by law, Noonaway is not liable for indirect, incidental, special, punitive, or consequential loss arising from use of the site. Nothing excludes liability that cannot legally be limited, including applicable consumer remedies.

10. Governing terms and changes

If a provision is unenforceable, the remaining provisions continue in effect. These Terms and incorporated policies form the agreement regarding the site and purchases. They are governed by applicable law, including mandatory consumer law. We may update these Terms by posting a revised version and, where required, providing notice.
